Do not rely only on the lease label
An apartment may have regulatory history even if a current lease does not clearly say so. New York State Homes and Community Renewal administers rent regulation and provides tenant online services, rent-registration information, fact sheets, and rent-history requests.
What to obtain
- Apartment rent history.
- Current and prior leases.
- Preferential-rent riders.
- HCR registrations and orders.
- Improvement or service-reduction records where relevant.
What to compare
Compare registered rents, lease rents, increases, vacancy history, improvements, preferential rent, and any claimed exemptions. Rent-overcharge analysis can be technical; preserve the records before drawing conclusions.
Outside NYC
The Emergency Tenant Protection Act allows qualifying municipalities outside New York City to adopt rent stabilization. HCR maintains current information on participating ETPA jurisdictions.
