The basic right
New York Real Property Law § 235-b provides a warranty that residential premises are fit for human habitation and that conditions are not dangerous, hazardous, or detrimental to life, health, or safety.
Build a repair record
- Send written notice.
- Keep dated photographs and video.
- Save work orders and portal tickets.
- Use 311 or local code enforcement where available.
- Keep inspection reports and violation numbers.
- Record every access appointment and missed appointment.
Court remedies
New York Courts now publishes statewide forms under RPAPL Article 7-D for tenants seeking a judgment directing repairs of dangerous, hazardous, or harmful conditions. NYC tenants may also encounter HP proceedings for repairs and code enforcement.
Rent withholding is not automatic protection
Habitability problems can affect rent claims, but withholding rent can still lead to a nonpayment case. Get jurisdiction-specific legal advice before choosing that strategy.
